Terms of Use
Effective and last updated: 12 September 2026
Please read these terms before using our websites, DiamondMaster App, and related digital services. They explain permitted use, intellectual property rights, important limitations on market information, and responsibilities when using the services. Please pay particular attention to the accuracy disclosures, liability limitations, and business-user indemnification below.
1. Covered services and providers
“We,” “our,” and “us” mean Artemis Dynamics Inc., a Wyoming corporation, and Wayne D. Prentice, each solely for the services that entity or person actually provides. These terms cover their websites and digital services offered through Finegems.com, Diamondescrow.com, and DiamondMaster App, including associated domains and subdomains providing or redirecting to the same services under these terms (the “Services”). Your applicable order, app listing, or engagement documents identify the contracting provider; contact us if you need clarification.
Other businesses are not automatically included because of common ownership, management, or hosting. Separate written sales, consultation, brokerage, escrow, confidentiality, subscription, and licensing agreements govern their particular subject matter and control over conflicting general provisions here. These terms do not replace transaction-specific agreements or reduce duties imposed by law.
2. Acceptance, eligibility, and authority
Where these terms are presented for acceptance, selecting an expressly labeled agreement control or otherwise affirmatively accepting forms an agreement with the applicable provider. If you do not agree, do not proceed with the service requiring acceptance. Copyright, confidentiality, and applicable law continue to govern access even where a contractual agreement has not been formed.
To open an account, join the Private Registry, or enter a transaction, you must be at least 18 and legally capable of contracting. If acting for a company or another person, you must have authority to bind and represent them. Provide accurate information, protect your access credentials, and promptly report suspected unauthorized access. You are responsible for use you authorize, but not automatically for activity outside your control or caused by our failure to meet our obligations.
3. Limited permission to use the Services
Subject to applicable licensing terms, we permit you to access and use the Services for lawful personal use or your own internal professional and business activities. You may retain ordinary copies of your own correspondence, transaction records, and outputs made available for download or export. Keep applicable attribution and proprietary notices. Client sharing of a particular report or output is permitted only to the extent authorized by its applicable license or engagement terms.
This permission does not authorize resale of access, redistribution of our software or databases, bulk republication, or creation of a competing data feed or service from restricted material. Open-source components and third-party materials remain subject to their own licenses, which control for those materials. Nothing here limits rights that applicable law does not allow us to restrict.
4. Copyrights and trademarks
To the extent protected by law, original text, photographs, illustrations, reports, software, interface designs, and original selection or arrangement of data belong to their respective rights holders, including Artemis Dynamics Inc., Wayne D. Prentice, and applicable contributors or licensors. All rights not expressly granted are reserved. Access does not transfer ownership. We do not claim copyright in unprotectable facts, ideas, public-domain material, or third-party works merely because they appear in the Services.
Finegems.com, Diamondescrow.com, DiamondMaster, Artemis Dynamics Inc., and associated names and logos are used as trade names or marks of their respective owners. This statement does not represent that every name or mark is registered. Third-party names and marks belong to their owners; references do not by themselves imply affiliation or endorsement. Do not use names, logos, or likenesses to falsely imply sponsorship, authorization, or endorsement. Lawful identification, commentary, criticism, fair use, and other protected uses remain permitted.
5. Automated access, scraping, and AI training
Except where expressly licensed or permitted by applicable law, you may not use bots, crawlers, scripts, or other automated methods to bulk collect, extract, republish, or commercially exploit our protected content, databases, private listings, or member information. You may not bypass authentication, paywalls, access restrictions, rate limits, or other technical safeguards.
We do not grant permission to use our protected content or restricted datasets to train, fine-tune, or evaluate machine-learning or generative-AI models, or to populate an external retrieval database, without prior written authorization. Public availability alone is not a grant of such a license. This reservation is subject to applicable law and does not assert that every use of facts or every AI-related use is unlawful.
Ordinary browser functions, assistive technologies, and reasonable search-engine indexing of public pages are permitted when they respect access controls and applicable crawler directives. Permission to index does not itself grant permission for model training or bulk republication. You may not upload private Registry information or another party's confidential documents to an external AI service without the required authority and appropriate confidentiality and privacy protections.
6. Acceptable use and security
Do not use the Services for fraud, impersonation, unlawful transactions, harassment, infringement, disclosure of another person's confidential information, unsolicited bulk messaging, or distribution of malware. Do not falsify ownership, provenance, grading reports, payment evidence, or identity documents, including through synthetic media or AI-generated alterations. Do not disrupt the Services, access another user's account, or conduct intrusive security testing without authorization.
Do not copy, modify, decompile, or reverse engineer protected software except as allowed by its license or applicable law. These terms do not prohibit honest reviews, lawful complaints, communications with regulators, protected whistleblowing, or other legally protected speech. Report suspected security issues privately through our contact form without including exposed credentials or confidential third-party data.
7. Your submissions and Registry confidentiality
You retain your rights in information and materials you submit. You confirm that you have the authority needed to provide them and that they are accurate to the best of your knowledge. You grant the applicable provider a limited, nonexclusive permission to receive, store, copy, format, and use them only as necessary to respond to your request, provide authorized services, protect the Services, and satisfy applicable legal obligations. Providers acting on our behalf may process them for those purposes under appropriate restrictions.
This permission does not authorize publication, unrelated advertising, sale of your information, or general-purpose AI-model training on confidential submissions. Any such training would require separate, specific authorization and applicable privacy safeguards. Disclosure to prospective counterparties and publication of listings remain subject to your authorization and our Privacy Policy.
Private Registry access does not authorize disclosure of other members' identities, interests, documents, or nonpublic transaction details. Keep confidential information secure and use it only for its authorized purpose, subject to lawful reporting and disclosure obligations. We may review, decline, restrict, or remove submissions reasonably believed to violate these terms or applicable law. Submission or membership does not guarantee approval, an introduction, a buyer, or a transaction.
8. DiamondMaster, market information, and errors
DiamondMaster and website prices, calculations, comparisons, currency conversions, historical figures, and appreciation estimates are informational tools. Unless expressly agreed in a separate engagement, they are not an individualized appraisal, grading certificate, authentication, executable quotation, investment recommendation, or guarantee of realizable value, liquidity, or future performance. General content is not legal, tax, or financial advice.
Results depend on inputs, assumptions, market category, source dates, exchange rates, units, and data availability. Sources may be delayed, incomplete, revised, or unavailable; cached or historical information may differ from current market conditions. Prices for natural and laboratory-grown diamonds, wholesale and retail transactions, and different qualities or markets are not interchangeable. Photographs and screen colors cannot establish an item's identity or condition.
Independently confirm material information, current pricing, grading, ownership, and transaction terms before relying on an output or committing funds. Obtain appropriate inspection and professional advice for the actual asset and transaction. Report suspected errors so we can investigate. We may correct content, calculations, or listings; corrections do not automatically amend an existing binding agreement or remove remedies required by law.
9. AI-assisted and automated material
Where a Service identifies material or a feature as AI-assisted or automated, its output may contain factual errors, omissions, bias, fabricated references, or misleading images. Check original sources and have a qualified person review material conclusions. Such output is not proof of authenticity, ownership, grading, or value. Do not present synthetic or altered material as an original certificate, verified fact, or an authorized statement by us or another person.
This section does not mean that every Service uses generative AI or that confidential submissions are sent to an AI provider. Actual processing remains governed by the Privacy Policy and any applicable feature-specific notice. An AI label does not waive our express commitments or responsibilities under applicable law.
10. Listings, transactions, escrow, and compliance
Unless expressly stated otherwise, public or private listings and inquiry-cart selections invite inquiries and do not themselves form a binding sale, reserve an item, or establish escrow. Availability, price, taxes, fees, inspection, delivery, returns, and acceptance are governed by the applicable quotation and transaction agreement. We may decline an inquiry or correct an unaccepted quotation. Any cancellation of an accepted order and associated refund must comply with its agreement and applicable law.
An introduction or use of the Diamondescrow.com name does not by itself establish a custodial, fiduciary, or escrow relationship or represent that a particular entity is a licensed escrow company. The actual provider, authority, duties, fees, and handling of funds must be set out in the applicable agreement. Independently verify payment and escrow instructions through a known contact before transferring funds or assets. Digital-asset transfers, where accepted, may be irreversible and require confirmation of the correct asset, network, and address.
Identity, beneficial ownership, source-of-funds, sanctions, KYC/AML, tax, ownership, and other documentation may be required depending on the operator, service, and applicable law. We may decline or pause a service when necessary information is unavailable or proceeding would violate applicable requirements. Confidentiality does not prevent required reporting or lawful recordkeeping.
Where Wayne D. Prentice provides California real estate brokerage services, his individual identification is California Real Estate Broker, DRE License No. 01232453. The responsible brokerage and scope of representation belong in the applicable engagement documents. This individual license is not a corporate brokerage license for Artemis Dynamics Inc. General website or app use alone does not create a brokerage or advisory engagement.
11. App licenses, purchases, and availability
DiamondMaster App is licensed rather than sold. For an App Store download, the applicable app license and Apple's usage rules govern the app license. Apple's Standard End User License Agreement applies where no valid custom EULA is supplied through the applicable distribution process. Posting these website terms does not by itself replace that EULA. In a conflict, mandatory platform terms and the applicable app EULA control for matters they govern.
If a paid feature or subscription is offered, the price, billing period, renewal terms, cancellation method, and refund rules must be disclosed before purchase. These terms alone do not authorize a charge or automatic renewal. Store-billed purchases are also subject to the store's payment and refund procedures and applicable law. Any promised features or support remain subject to the purchase terms. Connectivity, compatible devices, and external data availability may affect operation; no perpetual data feed or update commitment is created merely by access to these terms.
12. External services and third-party content
Linked websites, external data, laboratories, financial institutions, escrow providers, and other independent services may have their own terms, privacy policies, fees, and limitations. A link or reference alone is not an endorsement or guarantee. We do not control their independent operations, but this does not excuse responsibilities we expressly undertake or that applicable law places on us.
13. Warranty limitations
To the fullest extent permitted by applicable law, the digital Services and general informational material are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement to that extent. We do not guarantee uninterrupted, error-free, completely secure, or continuously current operation.
These limitations do not override express written warranties, transaction-specific commitments, required professional duties, or consumer guarantees that cannot lawfully be excluded. They do not independently disclaim warranties on goods sold under a separate transaction agreement.
14. Limitation of liability
To the extent permitted by applicable law, the applicable provider and its officers, employees, and service providers are not liable under these general digital-use terms for indirect, incidental, special, or consequential damages, including lost profits, lost business opportunities, or loss of data, arising from use of or inability to use the digital Services.
To that same extent, their combined aggregate liability for claims arising from the affected website or digital Service is limited to the greater of US $100 or the amount you paid the applicable provider for that digital Service in the 12 months before the event giving rise to the claim. This cap applies across claims arising from that event, whether pleaded in contract, tort, or another legal theory. An applicable app EULA or separately agreed service contract controls where it specifies a different limitation.
These exclusions and this cap do not apply to fraud, willful misconduct, gross negligence, liability that cannot lawfully be limited, or your nonwaivable statutory rights. They do not limit obligations to account for or return entrusted funds or assets, required refunds, or duties arising from separate sales, escrow, brokerage, or professional consultation engagements. Any limitation for those engagements must be addressed in their own agreements and remain subject to applicable law.
15. Business-user indemnification
If you use the Services on behalf of a business, that business agrees, to the extent permitted by law, to indemnify the applicable provider and its officers and employees against third-party claims and reasonable resulting costs, including reasonable legal fees, to the extent caused by the business's material breach of these terms, unlawful use, or submission of material that infringes another party's rights. This obligation does not cover losses caused by the indemnified party's own negligence, misconduct, or breach, and does not apply to an individual's ordinary personal consumer use.
We will give prompt notice of a claim and reasonable cooperation at the business's expense. The business may control the defense with reasonably acceptable counsel, subject to conflicts of interest. No settlement may admit fault by us or impose nonmonetary obligations on us without our consent, which will not be unreasonably withheld.
16. Suspension, termination, and changes
We may reasonably restrict or suspend access to address security threats, material violations, nonpayment where applicable, or legal requirements. Where practicable, we provide notice and an opportunity to resolve the issue; urgent protective action may be immediate. Termination does not eliminate earned payment obligations, required refunds, applicable access rights, or duties concerning client funds, property, and retained records. Provisions intended by their nature to survive continue to apply to prior use and accrued claims.
We may revise these terms prospectively, publish the revision and effective date, and give prominent notice of material changes on the affected Service or directly where appropriate. We seek renewed acceptance when required. Posting a revision alone does not establish acceptance or retroactively change completed transactions or accrued claims. Changes to paid services remain subject to their agreements and applicable law.
17. Applicable law and preserved rights
To the extent a valid agreement incorporates these terms and no controlling service agreement provides otherwise, California law governs, excluding conflict-of-law rules. Mandatory protections of your jurisdiction remain available. Disputes may be brought in a court with proper jurisdiction and venue, subject to any valid controlling agreement. These terms impose no mandatory arbitration, class-action waiver, or waiver of access to regulators or small claims procedures.
If a provision is unenforceable, it will be limited or severed as permitted by law while the remaining provisions continue to apply. A failure to enforce a provision is not a continuing waiver. Nothing in these terms limits rights or remedies that cannot lawfully be waived or overrides our Privacy Policy's restrictions on personal information and confidential submissions.
